Is CBD in NY Legal?

CBD in NY is a pretty hot topic in these times of chaos and uncertainty. One of the benefits that CBD may have to offer is the ability to invoke calmness and relaxation in the person that uses it. People all over the world could use all of the calm and relaxation they can get in these crazy times. Who knows…maybe if everybody in the world took a good dose of CBD all of the modern-day problems would go away. Maybe not…but it’s ok to dream.

CBD in New York

Although there are some pretty strict laws that surround the production and use of CBD in the state of New York, it is definitely legal. If you were to want to go to a restaurant and order food or beverages that are infused with CBD you might be in jeopardy of breaking a few laws, but if you are just wanting to use CBD for recreational purposes in the form of a CBD tincture, some CBD gummies, or even some CBD softgels it is perfectly legal to buy, sell, and use CBD in New York.

CBD Edibles

Even though it is not legal for companies to sell CBD infused food or drink products, that doesn’t mean that you can’t make your own. You can research the internet and find thousands of great recipes for CBD from rich, decadent chocolate chip cookies, to robust mashed potatoes with CBD infused cheese sauce. Fortunately, there are some incredibly talented and creative people out there that share a strong passion for CBD edibles and can take you on a step by step informational journey towards creating delicious, and effective CBD treats.

Hemp Extracts and THC

Although CBD is legal in the state of New York, at this time, marijuana is not. One of the things that allow for industrial hemp growth in the United States is that the hemp plant itself can not legally contain a presence of THC more than 0.3%. What this means is that once a hemp plant matures to the point where it naturally produces a THC content of more than 0.3% it becomes a marijuana plant in the eyes of the law and can be confiscated by the government. This law can make things a little difficult for hemp farmers in New York. The reason why is that they have to make sure that the hemp plants mature enough to produce the highest content of CBD that they possibly can, without allowing the THC content to rise above the legal limit. This can be a little tricky for the farmers that don’t have the experience and the knowledge that it takes to properly cultivate healthy hemp plants.

THC and CBD

Although CBD and THC are both cannabinoids that come from the genus of cannabis plants that evolved into what we know as hemp today, they are quite a bit different from each other on a cellular level. CBD interacts with the endocannabinoid system that we all have within our bodies in a way that differs from THC. Where THC directly binds to the endocannabinoid receptors and causes a direct effect, CBD influences the receptors to either work or not work. In this fashion, the receptor is influenced by the CBD to either send a signal to allow an action or not send a signal so that an action does not take place. This kind of communication is much like a binary conversation in the technical levels of a computer it is either on or off a 1 or a 0. It is because of the way that THC directly attaches itself to the receptor that scientists have not yet been able to say whether or not THC is dangerous within its psychoactive traits.

CBD is Legal

Essentially, CBD is legal in all 50 states of the United States. Although each state has its own regulations and laws in effect regarding the details, CBD is absolutely legal in New York.
